Facts in brief:
The Defendant is the sole director and majority shareholder of a company. The company was engaged as a contractor to assist in the construction of a shed. Another company was also engaged to install the roof and guttering for the shed, the victim was their employee.

The Defendant had instructed a builder to alter the scaffolding by lowering the platform so that the builder could fit fascia boards. The Defendant did not instruct the builder to reinstate the scaffold back to the original level. The victim was tasked with removing protective plastic from the roof sheets and was working on a steep section of the roof while it was raining. He slipped and fell approximately 4.5 m through a gap left in the scaffold by one of the missing sections of guardrail.

The victim suffered a dislocated right wrist and multiple fractures to his right arm and elbow.
