Facts in brief:
The Defendant company employed the victim as a machine operator. On 18 September 2013, the employee and Foundry Supervisor were operating a direct manufacturing continuous casting machine (the DMCCM).

Two employees are required to operate the DMCCM, one from the top platform and one from the ground. The victim noticed the lead sheet of metal had become crinkled and he attempted to smooth out the crinkle with his right gloved hand and his fingers became cause in the pinch point of the roller. The roller and back plate were extremely hot burning the victim’s hand.

The victim suffered a fracture to the little finger and serious burns to the little finger, ring finger and middle finger of his right hand.
