WorkSafe has granted an exemption (SEP2313) to Aalto Group Limited from compliance with regulation 11.36(2) of the Health and Safety at Work (Hazardous Substances) Regulations 2017 in relation to the construction requirements for a workroom located at 7 Akatea road, Glendene, Auckland.
The exemption is granted by WorkSafe in accordance with section 220 of the Health and Safety at Work Act 2015 on the basis that WorkSafe is satisfied that—
- the extent of the exemption is not broader than is reasonably necessary to address the matters that gave rise to the proposed exemption; and
- the exemption is not inconsistent with the purpose of the Act as it is not possible to comply with the FRR requirements of the door as doors with a fire resistance rating of -/240/60 are no longer commercially available. There is no greater health and safety risk to workers and others on-site given the mitigation measures in place; and
- this is a situation where there is good reason to grant an exemption under section 220(1).
The exemption comes into effect 4 March 2025 and expires on 4 March 2030 unless it is replaced sooner or revoked.
