WorkSafe has amended exemption HS2207 granted to Civil Aviation Authority of New Zealand on 27 August 2024 in relation to the Health and Safety at Work (Hazardous Substances) Regulations 2017 and the storage of explosive substances.
The amendment is granted in accordance with section 220 of the Health and Safety at Work Act 2015 (the Act) on the basis that WorkSafe is satisfied that:
- the extent of the amendment is not broader than is reasonably necessary to address the matters that gave rise to the proposed amendment; and
- the amendment is not inconsistent with the purpose of the Act as it does not result in increased health and safety risks to workers and other people with the safety controls that are in place on exemption HS2207. These safety controls are not changed by the amendment; and
- this is a situation where it is necessary and appropriate to exercise discretion to grant an amendment under section 220(1) of the Act.
The amendment to exemption HS2207 takes effect on 9 January 2025 and expires on 30 August 2029 unless it is replaced sooner or revoked.
