The Defendant is the sole director of Forest & Farm Services Limited.
The victim was employed by the company as a general handyman, and was operating the log splitter as part of his duties. Approximately a year before the accident, the control level on the log splitter connecting the two-hand controls broke. He modified the machine so that the blade could be raised and lowered using the leg control.
On the day of the accident, the victim was splitting a pine block and when he was reaching for the split block, he accidentally lowered pushed the leg control with his right knee causing the blade to low, crushing his hand between the blade and the piece of wood he was holding.
