Facts in brief:
The Defendant was a project management company engaged to manage a building project. The contract required the Defendant to visit the site every week day for the duration of the project, and set out certain responsibilities it had for health and safety.

The victim was working on a scaffold that consisted of unsecured timber planks. The scaffold was only checked inadequately and infrequently. Three of the planks uplifted and the victim slipped and fell six metres to the ground, his head landing in a small landscaped area, barely missing the concrete. He suffered a laceration to the top of his head, an abrasion to his right cheekbone and bruises along the outside of his abdominal wall and broken bones.
